Disha Salian case: Ex-Mumbai cop seeks right to be heard if CBI asks for his custody

Dismissed Mumbai police officer Sachin Waze, who is in judicial custody in the Antilia explosives case, has approached a special NIA court seeking an opportunity to present his side if the Central Bureau of Investigation (CBI) seeks his production in its newly registered case concerning the death of celebrity manager Disha Salian.

Waze submitted a handwritten application to the court after learning about the CBI case through media reports. In his two-page plea, he said that although his name is mentioned in the FIR, he has not been named as an accused.

Waze has asked the court to hear his submissions before passing any order on his production if the CBI approaches the court seeking his custody or appearance in connection with the FIR.WAZE DENIES LINKS TO SALIAN LAWYER

In his application, Waze also referred to what he described as a “smear campaign” being carried out by certain advocates and media organisations. He specifically referred to the lawyer representing Disha Salian’s father, Satish Salian.

Waze said he did not know anyone connected with Salian’s lawyer and denied any possibility of an “extra-judicial confession." He sought to place these points on record through his application.

The plea comes days after the CBI registered an FIR following a direction from the Bombay High Court. The court had ordered a fresh investigation into the circumstances surrounding Salian’s death and directed the agency to register an FIR. The court had also clarified that no person should be treated as an accused without sufficient material emerging during the investigation.

The CBI registered the FIR after recording the statement of Satish Salian, who had approached the Bombay High Court seeking a fresh investigation into his daughter’s death. The FIR covers allegations including murder, gang rape and destruction of evidence, according to reports.

While the FIR does not formally name anyone as an accused, its contents mention several individuals whose roles the agency is expected to examine, including Aaditya Thackeray, Dino Morea and Rhea Chakraborty.

Disha Salian, who worked as actor Sushant Singh Rajput’s manager, died after falling from a residential building in Mumbai on June 8, 2020. Her death occurred days before Rajput was found dead at his Bandra residence.

The Bombay High Court ordered the CBI probe on September 2 after considering concerns raised by Salian’s father over the earlier investigation. The court directed the agency to examine all aspects surrounding the circumstances of her death.
