Former DGP Tomin Thachankary approaches Kerala HC in appeal against disproportionate assets case conviction

Former Director General of Police Tomin J. Thachankary approached the Kerala High Court on Friday against a Vigilance Court order, which convicted him in the disproportionate assets case. Mr. Thachankary contended that the prosecution had miscalculated his rental income, property income, payments made by his relatives, and properties acquired by his wife. He argued that the trial court had not considered his revised income tax returns.Β 

He also claimed that the Vigilance Court did not consider his wife's earnings from her business and agricultural properties. The trial court failed to assess the actual income he received during the investigation period, but took expenditure not actually incurred into account, he claimed. Mr. Thachankary further stated that the trial court should have noted that the income tax assessment took place after the crime registration.Β 

The Vigilance Court sentenced Mr. Thachankary to four years of rigorous imprisonment and a fine of β‚Ή30.84 lakh on September 17. A Single Bench of Justice A. Badharudeen will consider the plea on September 22.Β The chargesheet filed by the Vigilance and Anti-Corruption Bureau stated that Mr. Thachankary had obtained assets worth β‚Ή64 lakh in addition to his declared sources of income.
