The state opposed his section 174 application for a discharge, arguing there is sufficient evidence for him to answer the charges, including that documents used to justify payments were allegedly falsified and that the state suffered financial prejudice.
The case relates to R12 million withdrawn from the state security agency's funds for Operation Mayibuye, an alleged intelligence operation to infiltrate the Economic Freedom Fighters' (EFF) internal structures and parliamentary caucus.
