Gurugram hit-and-run accused sent to police remand in biker Siya case

A Gurugram court on Wednesday sent hit-and-run accused Kalyan Bainsla and his cousin Lavnish, who was with him in the car, to two days of police remand in the case involving biker Shivani Chauhan, also known as Siya. Police had sought the remand to recreate the crime scene, and the next hearing has been scheduled for September 18.

The case relates to an incident on Sunday on Golf Course Road, where Bainsla, a gym owner, allegedly hit Chauhan's bike from behind while driving at speed, knocking her off and sending her skidding on the road. Police later added attempt to murder and other charges to the FIR after Chauhan joined the investigation.

According to an official, the court of Nidhi Beniwal granted the police request for a two-day remand. At the hearing, Bainsla's counsel Lalit Bindal argued that his client had already been in police custody for 24 hours and that the scene could have been recreated during that time. Bindal said, "Allowing the remand application filed by the police today, seeking two days of police custody, the court has awarded two days of police custody, with the next hearing scheduled for September 18."

Bainsla, 33, and Lavnish, 34, were arrested from Rajgarh in Rajasthan, near Gurugram, on Tuesday. Police said that after his arrest, Bainsla tried to escape custody on the pretext of urinating, but fell and was injured. He was later given first aid at a hospital.

Police said Bainsla was driving a Maruti Suzuki Ciaz, while Chauhan was riding an Aprilia RS 457 when the incident took place. The car, which is registered in the name of an acquaintance, has been impounded.

Chauhan said Bainsla's arrest alone was not enough and demanded action against the others who were allegedly in the car. Speaking to the media on Tuesday night after recording her statement in the district court, she said, "There were two other people in the car. They should be arrested as well. They must be punished. If they aren't, such incidents will continue to happen." She also said that if Bainsla got bail in three days, it could not be seen as strict action.

She also responded to Bainsla's cousin Kamal, who had claimed that she was playing the victim card. Kamal told PTI Videos, "The girl is playing the victim card. Kalyan is innocent. They are influencing people to ride bikes at high speed." Chauhan rejected the allegation and said, "I contested the municipal election from Kalkaji, Delhi, in 2022. I was the youngest candidate. Everyone in Delhi knows me. After the incident, I didn't want to reveal my identity, but now it has been revealed. I will stand firm for myself. I don't care what their followers are saying. Their mentality is simply flawed."

Chauhan said she told the court that an attempt had been made on her life. "I have sustained some injuries, and the doctors have advised me to undergo an MRI and X-rays," she said. She also said she could have died in the incident.

Addressing the media on Tuesday, Gurugram DCP (East) Sandeep Kumar said the victim had claimed that Bainsla hurled a slur at her before the incident and tried to kill her. He said, "It can be clearly seen that he deliberately hit (the biker) from the side after an argument The intent was to kill the victim. The victim has also told the police that the intention was to kill her."

Police Commissioner Sibash Kabiraj said Bainsla was booked for attempt to murder after scrutiny of Instagram videos and CCTV footage. Earlier, after giving an interview to the media, Bainsla switched off his mobile phone and absconded. Three police teams were formed to track him down, and he was later arrested in Rajasthan.

According to the police, on September 14, a female biker posted an Instagram video saying she had been hit by a car on Golf Course Road the previous morning. As there was no formal complaint at the time, Gurugram Police registered a suo motu case at Sector-56 Police Station. After Bainsla's arrest, Chauhan joined the investigation, and on her complaint, police added Section 109 (attempt to murder), Section 78 (physical and digital stalking), and Section 79 (acts against the modesty of a woman) of the Bharatiya Nyaya Sanhita to the FIR.

With both accused now in police remand, investigators are set to recreate the scene as the case moves to its next hearing on September 18.
