The former head of the Investigating Directorate Against Corruption, Andrea Johnson, and former senior crime intelligence official Maj-Gen Feroz Khan were granted bail of R10,000 each by the Pretoria magistrate’s court on Friday.

The duo face charges related to defeating the ends of justice, assault with intent to cause grievous bodily harm, and contraventions of the National Prosecuting Authority Act.

The case was postponed until February 2 2027.

Johnson has also been ordered to surrender her passport.

According to the charge sheet, on June 26 2018, Khan — who was employed by SAPS as a major general attached to crime intelligence and stationed at Erasmuskloof Crime Intelligence offices in Pretoria — had a serious argument with his junior SAPS crime intelligence female employee, Brig Manana Leonora Phetlhe.

The argument led to a physical confrontation where Khan allegedly attacked Phethle with a pen by stabbing her.

He allegedly further hit her with his hands and a paper file, and as a result, she sustained injuries to her face and her chest area.

Phethle opened a criminal case on the same day. On July 5 2018, the investigating officer was surprised when Khan submitted a “warning statement” without being asked to by the investigators.

Khan’s statement was submitted before the docket was submitted to the National Prosecuting Authority (NPA) for guidance and decision.

State investigations revealed that on July 4 2018, a journalist, who allegedly illegally received the contents of the said docket from his undisclosed source, shared them with Johnson.

On the same day, Johnson allegedly received them and allegedly forwarded the same to the “suspect”, who was Khan, seemingly so he could prepare himself for the pending criminal investigations and possibly an internal probe.

According to the state. Khan and Johnson knew such conduct was wrong in that Khan telephonically linked his junior administrative police official to Johnson to exchange private email addresses in order for Johnson to send the docket contents.

The state alleges Johnson instructed the said official to delete the email after printing the contents for Khan.

Investigations revealed that Johnson and Khan had a close relationship.

“It was revealed that Johnson attended a private party of Khan, and later on, when Johnson’s husband was going for job interviews in Khan’s unit, he sat in those interviews (instead of recusing himself) and selected the said husband.”

On July 26, Johnson allegedly submitted her letter of resignation to the national director of public prosecutions Andy Mothibi, as well as President Cyril Ramaphosa.
