Man sentenced to life imprisonment for killing brutally killing his daughter.

A 39-year-old Limpopo man who brutally killed his four-year-old daughter has been sentenced to life imprisonment.

Tshilidzi Vincent Mudau was sentenced by the Waterval Regional Court to life imprisonment for murder and 10 years for arson. The sentences will run concurrently, resulting in an effective sentence of life imprisonment.

National Prosecuting Authority (NPA) regional spokesperson Mashudu Malabi said the incident occurred on December 4, 2023, at Ha-Maila Kanana in Tshitale.

Malabi said the child’s mother had applied for a protection order against Mudau and after learning about the application, Mudau telephoned her and threatened to burn down her house and kill their four-year-old daughter if she did not allow him access to the child.

"Later that day, the mother received information that her house had been set alight, and she rushed to the scene with members of her family. While she was speaking to the police, the accused arrived, forcibly snatched the child from her arms, and fled.

"A short distance away, he held the child by her legs and smashed her head against the ground twice. The child sustained multiple skull fractures and succumbed to her injuries," said Malabi.

Mudau was arrested shortly afterwards.

Mudau pleaded not guilty to both murder and arson charges.

Malabi said Mudau was represented by several legal representatives during the trial before eventually choosing to conduct his own defence.

During sentencing proceedings, State Prosecutor Lebogang Maluleke described the matter as a brutal form of gender-based violence.

The prosecution argued that the victim was among the most vulnerable members of society and that the courts had a responsibility to protect society from offenders who commit such serious crimes.

The State also told the court that Mudau was not a first-time offender and had eight previous convictions for violent offences.

According to the NPA, the convictions demonstrated a pattern of violent conduct. Prosecutors argued that Mudau was not a suitable candidate for rehabilitation, had shown extreme cruelty towards the child and her mother, and had displayed no remorse.

The NPA welcomed the sentence, with Limpopo Director of Public Prosecutions Advocate Ivy Thenga saying perpetrators of violent crimes must be held accountable.

“The sanctity of human life can never be overemphasised,” Thenga said.

“The NPA remains steadfast in its commitment to ensuring that perpetrators of violent crimes are held accountable. We will continue to pursue these matters vigorously to protect the most vulnerable members of our society and to send a clear message that such conduct will not be tolerated.”

Thenga also commended the prosecution and investigating teams for their commitment and diligence in securing justice for the child and her family.
