Surabaya District Attorney Ends Ony Setiawan’s Case Following His Death from Heart Attack

SURABAYA, KOMPAS.com - The Head of Intelligence at the Surabaya District Attorney’s Office, Emanuel Yogi Budi Aryanto, confirmed the termination of the corruption case involving Ony Setiawan at the East Java Energy and Mineral Resources Office (ESDM).

This follows the death of the former Head of the Mining Division at the East Java ESDM due to a heart attack.

“For Ony, the case is stopped because he has passed away. The other three suspects will continue,” Emanuel told Kompas.com on Friday (18/9/2026).

The three other suspects whose cases are ongoing are Aris Mukiyono, Head of the East Java ESDM; Hermawan, Chair of the Water and Land Utilization Task Force; and Ertika Dinawati, Head of the Geology and Groundwater Division (GAT).

Emanuel added that before his death, the late Ony had complained of health problems while detained at the East Java High Prosecutor’s Office Detention Center.

Detention officers tried to provide medical assistance by taking him to Ahmad Yani Islamic Hospital (RSI) in Surabaya. However, the former East Java ESDM official did not survive.

“He passed away at RSI,” Emanuel continued.

Previously, the East Java High Prosecutor’s Special Crimes investigators handed over three suspects along with evidence (Phase II) to the Surabaya District Attorney’s Office on Tuesday (11/8/2026).

The transfer of the case files to the Surabaya Corruption Court was delayed because the Surabaya District Attorney chose to consolidate the indictment files.

“One more suspect (Ertika Dinawati) is about to enter Phase II, so we prefer to submit the files together,” Emanuel explained last Thursday (27/8/2026).

The consolidation aims to enable simultaneous prosecution of all defendants before a single panel of judges.

In this case, the suspects are strongly suspected of jointly committing corruption in the form of illegal levies related to their official positions.

They used these strategic positions to generate illicit funds from mining permit applicants.

For their actions, all four suspects have been charged under Article 12 letter E of the Corruption Crimes Law (UU Tipikor) concerning extortion by officials, Article 12 letter B of the same law concerning gratuities, and Article 606 paragraph (2) juncto Law Number 1 of 2023 concerning the Criminal Code.
