The story so far: A Public Interest Litigation (PIL) petition in the Supreme Court has challenged the provisions of the Transgender Persons (Protection of Rights) Act, 2019, as amended in 2026, arguing that the legal recognition of gender identity should not automatically entitle a person to constitutional and statutory protections specifically provided to women.
The petition has been filed by Women’s Declaration International India under Article 32 of the Constitution. It is the India chapter of the UK-based Women’s Declaration International. It describes itself as a feminist, non-partisan, all-volunteer and all-female organisation advocating for women’s rights, dignity, safety, and freedom.
